Terms and Conditions

1. INTRODUCTION

These terms and conditions ("Terms") are entered into between you ("you" or "user") and 1&Dwitiya Technologies Private Limited for accessing registration and interacting with our website mobile application and any other technology platform owned and operated by us ("RentenPe Platform") and all the products and services available through the RentenPe Platform.

This document / contract / understanding is an electronic record published in accordance with the provisions of the Information Technology Act, 2000 and rules made thereunder as applicable and the amended provisions pertaining to electronic records in various statutes as may be amended by the Information Technology Act, 2000 from time to time. This electronic record is generated by a computer system and does not require any physical or digital signatures.

By continuing to use or access of the RentenPe Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you are advised to not use or access the Services offered on the RentenPe Platform.

When you use any of the Services provided through the RentenPe Platform, you will be subject to the specific Terms applicable to such Services, and they shall be considered as part and parcel of the Agreement (defined below).

While the Terms generally apply to all users that access the RentenPe Platform, certain identified portions of the Terms are directed towards Tenants and Landlords (defined below) specifically.

Your access of the RentenPe Platform signifies your acceptance of these Terms. We reserve the right to modify these Terms at any time without notice, and your continued access of the Terms after any modifications will constitute your acceptance of such modifications.


2. DEFINITIONS

Capitalised terms not defined in the Terms shall mean as follows:

"Agreement" means and includes the Terms, Privacy Policy and any other such terms and conditions that may be mutually agreed upon between RentenPe and the user in relation to the Services offered through the RentenPe Platform.

"Applicable Law" means and includes any statute, law, regulation, sub-ordinate legislation, ordinance, rule, judgment, rule of law, order (interim or final), writ, decree, clearance, Authorisations, approval, directive, circular guideline, policy, requirement, code of practice or guidance note, or other governmental, regulatory, statutory, administrative restriction or any similar form of decision, or determination by, or any interpretation or administration of any of the foregoing by, any statutory or regulatory authority or government agency or any other authority, in each case having jurisdiction over the subject matter of this Agreement.

"Confidential Information" means all information that is not in the public domain, in spoken, printed, electronic or any other form or medium, relating directly or indirectly to, the assets, business processes, practices, methods, policies, subscription plans, publications, documents, research, operations, services, strategies, techniques, agreements, contracts, terms of agreements, transactions, potential transactions, negotiations, pending negotiations, know-how, trade secrets, computer programs, computer software, applications, operating systems, software design, web design, work-in process, databases, manuals, records and reports, articles, systems, material, sources of material, supplier identity and information, vendor identity and information, user identity and information, financial information, results, accounting information, accounting records, legal information, marketing information, advertising information, pricing information, credit information, developments, internal controls, security procedures, graphics, drawings, sketches, sales information, costs, formulae, product plans, designs, ideas, inventions, original works of authorship, discoveries and specifications, of RentenPe and / or affiliates or their respective businesses, or any existing or prospective customer, supplier, investor or other associated third party, or of any other person or entity that has entrusted information to RentenPe in confidence.

"Content" means all text, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, sounds, music, artwork and computer code collectively.

"Force Majeure Event" means any event due to any cause beyond the reasonable control of RentenPe, including, without limitation, unavailability of any communication system, breach or virus in the systems, fire, pandemic, flood, explosion, acts of God, civil commotion, riots, insurrection, war, acts of government.

"Free Rent Amount" means an amount that is equivalent to one month’s rent for a Tenant calculated on the basis of the rental agreement which is uploaded to the RentenPe Platform and verified. This amount is capped at INR 20,000.

"KYC" means know your customer.

"Landlord" means a user who registers on the RentenPe Platform as a 'landlord' for availing Services offered on the RentenPe Platform, including but not limited to Residence Card services, conducting background verification checks on Tenants and receiving Rental Payments from Tenants.

"Person" means any natural person, company, corporation, partnership, proprietorship, trust, union, association, government or any agency thereof or any other entity that may be treated as a person under Applicable Law.

"Personal Information" means details of Aadhaar Card, PAN Card, biometric information, financial information such as bank account, debit card or credit card details, and such other sensitive information, of the user, and / or concerned person which personally identifies such user and / or person.

"RentenPe Platform" means the website, mobile application and any other technology platform owned and operated by 1&Dwitiya Technologies Private Limited.

"Residence Card" means the digital card generated for Tenants and Landlords which serves as a repository of all relevant rental information pertaining to such Tenants and Landlords, including but not limited to their photo, name, rental history, unique ID, date on which they joined the RentenPe Platform, status of background verification checks / KYC conducted on them (which may be indicated with a green or blue tick), identity documents and transaction history through which users register on the RentenPe Platform, verify or view their information including rental and transaction history.

"Rent Credit Score" means the dynamic score assigned to Tenants based on their usage and engagement with the RentenPe Platform, and consists of a multitude of parameters including but not limited to payment behavior, consistency, tenant verification, tenancy location and rent amount, multiple tenancy, rental loan(s), history of disputes and complaints, rental arrears, termination rate, and period of inactivity. Rent Credit Score is a scoring system designed to assess the rent payment history and reliability of Tenants.

"RentenPe" or "we" or "us" or "our" means 1&Dwitiya Technologies Private Limited, a company incorporated under the provisions of the Companies Act, 2013 with CIN U72900MH2022PTC377390, having its registered office at 314, Prabhadevi Industrial Estate, Sawtantra Veer Savarkar Marg, Opp Shri Siddhivinayak Temple, Prabhadevi, Maharashtra, India.

"RBI" means Reserve Bank of India.

"Services" means and includes the services provided by / to be provided by RentenPe, either through itself or through Third Party Service Providers within the territory of India to the users of the RentenPe Platform and includes Residence Card services, Rental Payment services, Gullak and Wallet services, Consultation services, R Safety services, R Wish services, Instant ID Check.

"Third Party Service Provider" means any service provider with whom RentenPe has an agreement for the purposes of making the Services available for users.These may include regulated entities offering financial services.

"Tenant" means a user who registers on the RentenPe Platform as a 'tenant' for availing Services offered on the RentenPe Platform, including but not limited to payment facilitation services related to Rental Payments, Residence Card services, and conducting Instant ID Check on landlords / drivers / house help / other third parties, etc.

"You" or "user" means any natural or legal person who accesses or uses the RentenPe Platform. All references to you include yourself and any other persons you are authorised to and required to provide consent for.


3. REPRESENTATION AND WARRANTIES

By accessing, logging in, browsing, or using the RentenPe Platform, you hereby represent and warrant that:
3.1. You are a resident of India.

3.2. You are over 18 years of age.

3.3. You are duly authorised, either individually or as an authorised signatory of an entity.

3.4. You have the capacity to enter into a legally binding agreement.

3.5. You are not barred or legally prohibited from accessing or using the RentenPe Platform.

3.6. You acknowledge and agree that we own all legal rights, titles and interests in and to the Services, including any intellectual property rights which subsist in the Services.

3.7. You understand that you do not have the right to use any of our trade names, trademarks, service marks, logos and domain names. You do not have the right to remove, obscure, or alter any proprietary rights notices (including trademark and copyright notices), which may be affixed to or contained within the Services. You will not copy or transmit any of the Services.

3.8. You hereby understand and acknowledge that the information (including Personal Information) requested from you is used for the various purposes as set out in our Privacy Policy as well as compliance with various laws, regulations and guidelines (including the Prevention of Money Laundering Act, 2002) promulgated by the Government of India from time to time.

3.9. You will remain responsible for all actions taken through your system, username, and password.

3.10. The information provided by you is true and correct.

3.11. You shall keep us updated of any change in the information provided on the RentenPe Platform.

3.12. Users are ultimately responsible for interacting with other users on the RentenPe Platform and RentenPe is only a facilitator that shall not be held responsible or liable for the interaction of the users with other users on the RentenPe Platform.

3.13. Please note that RentenPe (a) does not recommend or endorse any user, i.e., it does not endorse any Landlords or Tenants registered on the RentenPe Platform; and (b) does not make any representations or warranties with respect to the users. RentenPe shall not be liable, for any reason whatsoever, for any disputes amongst the users and there is no liability on RentenPe for the consequences that the users may be subjected to while dealing with other users on the RentenPe Platform.

3.14. Information regarding all the users and / or any third party whose services the users avail through the RentenPe Platform as displayed on the RentenPe Platform is intended for general reference purposes only. Such information is mainly self-reported by the users and / or third parties and verified by RentenPe, and may change from time to time or become out of date or inaccurate. Users are encouraged to independently verify any such information the users see on the RentenPe Platform with respect to the other users.

3.15. Users understand and agree that any interactions and associated issues with the other users and / or the third parties with whom the users interact through the RentenPe Platform or the third party whose services the users avail through the RentenPe Platform including but not limited to any service-related issues, any fraudulent activity, etc. is strictly amongst the users and / or the third party and the user shall not hold RentenPe responsible for any such interactions and associated issues. If a user decides to engage with other users through the RentenPe Platform, they would do so at their own risk.

3.16. RentenPe cannot assure that all the transactions will be completed nor does RentenPe guarantee the ability or intent of the users to fulfil their obligations under any transaction. RentenPe advises users to perform their own investigation prior to interacting with the other users on the RentenPe Platform.


4. FEE AND CHARGES

4.1. RentenPe offers a combination of Services which users may avail / subscribe to, subject to the need of the user, upon payment of applicable fees.

4.2. RentenPe may also offer certain Services on a one-time payment basis upon payment of applicable fees.

4.3. RentenPe reserves the right to revise the fee of any Service without notice to the user at any time prior to, at the time of, during the tenor or post subscription or purchase of Service by the user. RentenPe shall intimate the user of such revised fees and the user undertakes to pay to RentenPe the difference in the amount after such revision if they wish to avail (or continue to avail) the Service.


5. PROPRIETARY RIGHTS

5.1. The software and hardware that support the RentenPe Platform, as well as other Internet related software necessary for accessing the RentenPe Platform, are solely our property and / or our authorised Third Party Service 'Providers' property.

5.2. Your permission to access the RentenPe Platform does not grant you any proprietary or ownership rights in the aforementioned software / hardware. You are prohibited from attempting to modify, translate, disassemble, reproduce, decompile, or reverse engineer the software / hardware underlying the RentenPe Platform or creating any derivative products based on the software / hardware. You shall be responsible for obtaining and maintaining all telephone, computer hardware and other equipment needed for access to and use of the RentenPe Platform and all charges related thereto.


6. PAYMENTS ON THE RENTENPE PLATFORM

We, either directly, or through business partners / vendors / Third Party Service Providers may enter into agreements with third party payment gateways / aggregators and financial institutions authorised by the RBI or any other regulatory authority for the purposes of, inter alia, processing disbursals, payments, collection, refund and remittance and to facilitate payment through the RentenPe Platform.


7. OBLIGATIONS OF THE USER

7.1. Review of Terms

It is your responsibility to thoroughly review these Terms on a periodic basis.

7.2 Use of Information and Materials

You are advised to exercise due caution and / or seek independent legal or financial advice before availing any facility or entering into any legal or financial obligation based on the Content contained on this RentenPe Platform. The information provided on the RentenPe Platform is based on information provided by users and no responsibility is taken by RentenPe for any error, omission or misunderstanding in construing those particulars.

7.3. Unauthorised Access

You shall be liable for all acts conducted by you on the RentenPe Platform and shall be responsible for the safekeeping of your access details and password. Subject to Applicable Law, you are responsible for notifying RentenPe immediately upon becoming aware of any unauthorised access into or misuse of your Residence Card causing a breach of security as per the Agreement. RentenPe shall extend support by ensuring immediate suspension or termination of such Residence Card and shall take such other appropriate safety measures as it may deem necessary. Further, RentenPe shall not be held liable for any unauthorised access of your Residence Card and / or any loss or damage caused to you by such unauthorised access or loss or damage caused as a consequence of the delay or failure on your part in informing RentenPe about such unauthorised access.


8. LINKS TO THIRD-PARTY PLATFORMS

The RentenPe Platform may contain links to third-party platforms. We do not control or endorse the Content, privacy policies, or practices of such third-party platforms. You are advised to access such third party links at your own risk, and we shall not be responsible for any third-party platforms or the Content, products, or services they offer. The Content, accuracy, opinions expressed, and other links provided by other third- party sites are not verified, monitored, or endorsed by us in any manner. The RentenPe Platform has been provided on an "as in" and "as available" basis. Accordingly, we encourage you to read and understand the terms and privacy policy of such third party platform upon being redirected from the RentenPe Platform.


9. CONTENT POSTED ON THE RENTENPE PLATFORM

You are solely responsible for the Content uploaded by you on the RentenPe Platform. You must ensure that all Content uploaded by you complies with the Terms and Appliable Law and does not infringe or violate any Person's rights. You retain any and all of your rights to any Content you upload, post or display on the RentenPe Platform and you are responsible for protecting those rights. RentenPe takes no responsibility and assumes no liability for Content uploaded on the RentenPe Platform by you or any third party through you. We may review, edit, or delete any Content that violates these Terms or is offensive, illegal, or harmful. By uploading Content on the RentenPe Platform, you understand that it will become a public disclosure of such Content by you and you grant RentenPe a worldwide, irrevocable, perpetual, non-exclusive license to use, copy, display, and distribute that Content.


10. USER CONDUCT

10.1. You acknowledge that all images, information, data, text, software, graphics, video, messages, or other Content, whether publicly posted or privately transmitted by you, are your sole responsibility. This means that you, and not RentenPe, shall bear full responsibility for all Content uploaded or posted by you on the RentenPe Platform. We do not exercise control over user-generated Content on the RentenPe Platform and, therefore, cannot guarantee the accuracy, integrity, or quality of such Content. By using the RentenPe Platform, you acknowledge the possibility of exposure to offensive, indecent, or objectionable Content uploaded.

10.2. In no event shall we be liable in any way for any Content, including but not limited to errors or omissions in any Content, or for any loss or damage of any kind resulting from the use of any user's Content posted, sent, transmitted, or made available on or through the RentenPe Platform.

10.3. You agree not to use the RentenPe Platform to host, display, upload, modify, publish, transmit, update, or share information that:

• Belongs to another Person without proper authorisation.

• Is grossly harmful, harassing, blasphemous, defamatory, obscene, pornographic, paedophilic, libelous, threatening, abusive, vulgar, tortious, invasive of another's privacy, hateful, racially or ethnically objectionable, disparaging, related to money laundering, gambling, or otherwise unlawful.

• Relate to or harms minors in any manner.

• Infringes or violates or misappropriates upon any patent, trademark, copyright, trade secrets, confidential information, or other proprietary rights.

• Threatens the unity, integrity, defense, security, or sovereignty of India, friendly relations with foreign states, public order, or incites the commission of any cognisable offense.

• Impersonates any Person or entity, including but not limited to RentenPe, its officials, directors, or employees, or falsely represents your affiliation with any person or entity.

• Forges headers or manipulates identifiers to conceal the origin of Content transmitted through the RentenPe Platform.

• Uploads, posts, sends, transmits, or otherwise makes available any Content that you do not have the right to share under any law or contractual or fiduciary duty / relationships.

• Distributes unsolicited or unauthorised advertising, promotional materials, junk mail, spam, chain letters, pyramid schemes, or any other form of solicitation.

• Uploads, posts, sends, transmits, or otherwise makes available any material containing software viruses, malware, or any other computer code designed to disrupt or harm computer software, hardware, or telecommunications equipment.

• Interferes with or disrupts the RentenPe Platform or servers or networks connected to the RentenPe Platform, or violates any network requirements, procedures, policies, or regulations.

• Wrongfully, illegally, or without consent, replace identities of individuals.

• Intentionally or unintentionally violates any applicable local, state, national, or international laws, rules of any national or other securities exchange, or regulations with the force of law.

• Transmits, or otherwise makes available any images or other Content of individuals without their knowledge or consent.

• Engages in any reproduction, duplication, copying, selling, trading, reselling, or exploitation of any portion of the RentenPe Platform, use of the RentenPe Platform, or access to the RentenPe Platform for commercial purposes.

10.4. Except for web browser software and applications formally approved by RentenPe in writing, you agree not to use any software, program, or device to automate access to or data retrieval from the RentenPe Platform.

10.5. You will not employ automated systems such as 'robots', 'spiders', 'scrapers', or 'offline readers' to access the RentenPe Platform.

10.6. You shall not collect personally identifiable information, including account names, from the RentenPe Platform or use it for commercial solicitation.

10.7. You shall refrain from indulging in the following acts while accessing the RentenPe Platform:

• Using the RentenPe Platform for illegal or offensive purposes.

• Attempting to compromise system integrity or security.

• Overloading the infrastructure with excessive actions.

• Uploading malicious software or viruses.

• Impersonating others or engaging in fraudulent activities.

• Interfering with the RentenPe Platform's proper operation.

• Bypassing access restrictions.

• Attempting to reverse engineer or discover source code.


11. TERMINATION

We reserve the right to permanently or temporarily terminate, suspend, or deny access to the RentenPe Platform without notice or liability for violations of the Terms or the provision of RentenPe Platform to you, is no longer commercially viable or feasible for us.


12.ACCESS

12.1. We reserve the right to withdraw or amend the RentenPe Platform without notice. We shall not be responsible for interruptions or cessation of the RentenPe Platform and the Services. We may restrict access to some parts of the RentenPe Platform to users from time to time for maintenance and other purposes. We make no warranties regarding, the access, speed, or availability of internet in general or the RentenPe Platform in particular. The RentenPe Platform is controlled from India, and users from other jurisdictions must comply with Indian laws.

12.2. Your responsibilities for accessing the RentenPe Platform include:

• Ensuring access to the RentenPe Platform is appropriately arranged.

• Ensuring that all individuals accessing the RentenPe Platform through your internet connection or device are informed about and compliant with the Terms.

• Providing accurate, current, and complete information when prompted for registration or other details to access the RentenPe Platform's resources. Your usage of the RentenPe Platform is subject to the accuracy and completeness of the information you provide. This information is also governed by our Privacy Policy, and you consent to our actions regarding your information in line with the Privacy Policy.

• Acknowledging our right to disable any username, password, or identifier, whether chosen by you or provided by us, at our sole discretion, for any reason, including if, in our judgment, you have violated any provision of the Terms.


13. OWNERSHIP OF INTELLECTUAL PROPERTY RIGHTS

13.1. We and our authorised partners retain exclusive rights and ownership on the RentenPe Platform Content (except user content and third party owned content), and the features and functionality of the RentenPe Platform. You may not use, copy, or reproduce these materials without prior written consent. All intellectual property rights are protected under Applicable Law.

13.2. The Content on the RentenPe Platform including but not limited to text, photographs, graphics, video and audio Content, financial data, news, research, recommendations, and opinions, is protected by copyright in favour of us under applicable copyright laws and is also safeguarded under general intellectual property law.

13.3. Third-party content appearing on the RentenPe Platform is the property of their respective owners and we do not assert any rights in relation to the same. Such third party content is used by us either on the basis permission from the third-party or pursuant fair use provisions.


14. DISCLAIMER

14.1. The RentenPe Platform is not a listing platform intended to connect prospective tenants with prospective landlords. Instead, the RentenPe Platform primarily endeavours to facilitate timely Rental Payment and provide ancillary services to the Tenants and Landlords in relation to their rental arrangements.

14.2. The RentenPe Platform and its Content are provided "as in" and "as available". The Services are chosen and used at a user's risk and discretion and RentenPe makes no representations or warranties, express or implied, to the user in relation to the Services or otherwise regarding this Agreement, including the implied warranties of merchantability and fitness for a particular purpose. We disclaim all warranties, express or implied, regarding the accuracy, timeliness, or completeness of the RentenPe Platform's Content. We are responsible for any errors, interruptions, or damages resulting from the access of the RentenPe Platform.

14.3. The information provided is for general information purposes. Decisions based on the Content displayed within the RentenPe Platform are your sole responsibility.

14.4. The user understands and acknowledges that the user assumes certain risks prior to interacting with other users / Persons / Third Party Service Providers on and through the RentenPe Platform, and the user shall be solely responsible for such user's personal assessment of specific requirements with regard to interaction with other users / Persons / Third-Party Service Providers.

14.5. RentenPe expressly disclaims any liability or responsibility whatsoever and howsoever arising as a result of any Content / Service made available on the RentenPe Platform through RentenPe or any third party, or any deficiency in service that is caused to the user due to a Third-Party Service Provider.

14.6. RentenPe does not have the obligation to physically meet and conduct verification of the users. The 'blue tick' and 'green tick' on the Residence Card on the RentenPe Platform refer to RentenPe's algorithm-based technological process through which users details are verified. This is on a best-effort basis and has its own limitations. RentenPe accepts user's details in good faith and shall not be held responsible with regard to the bonafides of the users.

14.7. We do not guarantee that:

• The RentenPe Platform's Services will meet your requirements.

• Any information sourced or obtained through the RentenPe Platform will meet your expectations.

• Results obtained from the RentenPe Platform will be accurate or reliable.

• We provide no guarantee against the possibility of data deletion, mis-delivery, or storage failure.

• We do not endorse or guarantee third-party products or services advertised on the RentenPe Platform. We shall not be responsible for transactions between you and third party providers.

• Any identified defects will be corrected or that the RentenPe Platform is free from viruses or other malicious, destructive or corrupting code, non-infringement of third-party rights, title, merchantability, data accuracy and completeness, satisfactory quality and / or fitness for a particular purpose.


15. INDEMNITY

We shall not be liable in case you breach any terms or conditions provided under the Agreement and will not be obligated to indemnify you for any direct or indirect losses accruing to you. You agree to indemnify, defend and hold harmless us, our affiliates, group companies and our directors, officers, employees, agents, Third Party Service Providers, and any other third party providing any service in relation to the Services whether directly or indirectly, from and against any and all losses, liabilities, claims, damages, costs and expenses (including legal fees and disbursements in connection therewith and interest chargeable thereon) asserted against or incurred by us that arise out of, result from, or may be payable by virtue of, any breach or non-performance of the Agreement including any representation, warranty, covenant or undertaking made or obligation to be performed by you pursuant to the Terms.


16. LIMITATION OF LIABILITY

IN NO EVENT SHALL RENTENPE, ITS OFFICERS, DIRECTORS AND EMPLOYEES, OR ITS CONTRACTORS, AGENTS, LICENSORS, PARTNERS, OR SUPPLIERS BE LIABLE TO YOU FOR ANY DIRECT, SPECIAL, INDIRECT, INCIDENTAL, CONSEQUENTIAL, PUNITIVE, RELIANCE, OR EXEMPLARY DAMAGES (INCLUDING WITHOUT LIMITATION LOST BUSINESS OPPORTUNITIES, LOST REVENUES, OR LOSS OF ANTICIPATED PROFITS OR ANY OTHER PECUNIARY OR NON-PECUNIARY LOSS OR DAMAGE OF ANY NATURE WHATSOEVER, INCLUDING BUT NOT LIMITED TO ABUSE OR BREACH OF DATA), EVEN IF RENTENPE OR AN AUTHORISED REPRESENTATIVE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, ARISING OUT OF OR RELATING TO (I) THESE TERMS, (II) THE RENTENPE PLATFORM, (III) YOUR USE OR INABILITY TO USE THE RENTENPE PLATFORM; OR (IV) ANY OTHER INTERACTIONS WITH ANOTHER USER IN CONNECTION WITH THE RENTENPE PLATFORM.


17. ASSIGNMENT

These Terms and all rights and obligations arising from the Terms may not be transferred or assigned by you but may be assigned by us to any third party without restriction.


18. FORCE MAJEURE

We shall not be liable for any failure to perform any obligations under the Terms or provide the Services or any part thereof if the performance is prevented, hindered or delayed by a Force Majeure Event and in such case its obligations shall be suspended for so long as the Force Majeure Event continues.


19. GOVERNING LAW

19.1. The Terms shall be governed by the laws of India, regardless of your actual location. You agree to the exclusive jurisdiction of Mumbai.

19.2. Disputes under the Terms shall be resolved through arbitration governed by the Arbitration and Conciliation Act, 1996. The seat of arbitration shall be Mumbai. The arbitration shall be conducted in English language, the arbitrator's award is final, and costs for the arbitration shall be borne by the user.


20. NOTICES

20.1.All legal notices or demands to or upon us shall be made in writing and sent by courier, certified mail, or electronic email to the following entity and address: 314 Prabhadevi Industrial Estate, Opposite Siddhivinayak Temple, VSV Road, Prabhadevi, Mumbai - 400025, or email at: help@rentenpe.com. The notices shall be effective when they are received by us in any of the above-mentioned manner.


20.2. All legal notices or demands to or upon a user shall be effective if either delivered personally, sent by courier, certified mail, by email to the last-known correspondence address or email address provided by the user to us, or by posting such notice or demand on an area of the RentenPe Platform that is publicly accessible without a charge. Notice to a user shall be deemed to be received by such user if and when, (a) we are able to demonstrate that communication, whether in physical or electronic form, has been sent to such user, or (b) immediately upon us posting such notice on an area of the RentenPe Platform that is publicly accessible without charge.


21. ENTIRE AGREEMENT / SEVERABILITY

21.1. These Terms, along with the Privacy Policy, legal disclaimers, and other legal notices on the RentenPe Platform, constitute the entire agreement between you and us.
21.2. If any provision of the Terms is deemed invalid by a court of competent jurisdiction, it would not affect the validity of the remaining provisions, which remain in full force.

We use cookies on our website for analysis, offering financial tools, providing unique content, and enhancing user experience. You can obtain further information about our usage of cookies through our Privacy Policy.


23. USAGE OF PERSONAL INFORMATION

Your Personal Information provided to us through the RentenPe Platform will be protected and only used in accordance with our Privacy Policy.


24. BREACH OF THE TERMS

These Terms constitute a legally binding contract between you and RentenPe. Please read them carefully and ensure you understand and agree to the Terms before accessing the RentenPe Platform. If you have any questions or concerns, please contact us at help@rentenpe.com. Without prejudice to RentenPe's other rights under these Terms, if you breach these Terms in any way or if RentenPe suspects that you have breached the Terms in any way, then RentenPe shall be entitled to take such action as it may deem necessary.


25. GRIEVANCE REDRESSAL

Any grievances or complaints by users relating to the discrepancies or misuse of information so provided to RentenPe may be addressed to the grievance officer appointed by RentenPe for this purpose, whose details are provided below.

26. FRAUD REPORTING

Law Enforcement Agencies can send legal requests / notices to us on help@rentenpe.com for assistance required on user details.

Additionally, in case you have any query(s), you can also call us on our Customer Helpline Number - 7710098503 during all 7 days a week, between 10:00 AM to 7:00 PM. We will try to respond within 72 hours of receiving the request from you.


27. REFUND / CANCELLATION OF SERVICES

27.1. Services, once paid for by a user through the RentenPe Platform, are non-refundable and non-cancellable in all cases.

27.2. For Services availed on a subscription basis, if a user cancels their subscription, they will not be refunded any amounts already paid and they would continue to have access to the service till the date on which the subscription ends ("Subscription Period"). However, their subscription would be cancelled and RentenPe would not automatically charge and provide them the Service from end of the Subscription Period. To obtain access to the Services in question in the future (post cancellation of subscription), the user will have to make a fresh purchase / get a subscription again.

27.3. RentenPe may consider exceptional cases on appeal by users and provide reconciliation to the user on a case-to-case basis. You may reach out to the Grievance Officer (details provided above) for further reconciliation / grievances if you believe that you have been wrongly charged for a Service by RentenPe.


28. TERMS SPECIFIC TO RESIDENCE CARD

In addition to the representations provided above, you hereby agree to the following additional terms and conditions for utilising the Services offered through the Residence Card.

28.1. You undertake and agree to provide your information, upload specified Content and create an Residence Card in order to retrieve and / or verify specific information and avail the Services.

28.2. RentenPe shall verify your mobile number by requesting for the one-time password ("OTP") from you. You undertake and agree that a mobile number can only be used once to create an Residence Card. You are prohibited from creating multiple Residence Cards and RentenPe reserves the right to conduct appropriate verification to detect such multiplicity of Residence Cards and take appropriate action.

28.3. You undertake to cooperate with any of RentenPe's personnel in connecting with your access to the RentenPe Platform, as may be required by RentenPe.

28.4. We shall not be held liable for any delay or rejection of approval of any rental agreements made between users in relation to their usage of the RentenPe Platform.

28.5. You agree to provide all information as may be required by RentenPe for verification of the details submitted by you, including all KYC documents and information as may be specified or required under Applicable Law. Such information or documents may be collected by us by either ourselves or through any Third Party Service Providers appointed by us to collect such information or documents on our behalf.

28.6. You agree that we may conduct independent background verification in relation to the information provided for creation of the Residence Card in addition to the KYC checks which may be conducted by our Third Party Service Providers.

28.7. In the capacity of a Tenant, you agree that background verification of your information including the home town address provided by you through the rental agreement may be verified by us on request by a Landlord.

28.8. In the capacity of a Landlord, you agree that background verification of your information including information provided by you through the rental agreement may be verified by us on request by a Tenant.

28.9. You confirm that all the particulars, information and details provided are true, correct and accurate and there is no suppression of any information. We reserve the right to suspend or terminate your account and deny access to the RentenPe Platform (or any part of it) if there is suspicion or evidence of false or incomplete information provided by you.

28.10.You acknowledge that we shall have the right to seek information pertaining to you from regulatory authorities, including inter-alia, the Central KYC Registry, the RBI, credit information companies in accordance with Applicable Law and the Privacy Policy.

28.11.You hereby confirm that your current address details match with address details available on your officially valid KYC documents and that any change in the same shall be duly communicated to us.Privacy Policy

28.12.You agree that in order to modify any details of your Residence Card, you would be required to undergo KYC and / or background verification process as relevant to the change prior to any such changes.

28.13.You agree that you may be assigned a dynamic 'Rent Credit Score' based on your engagement with the RentenPe Platform (including verification of information and rental payment history) which shall be visible on your Residence Card to other users on the RentenPe Platform. You understand that the Rent Credit Score is dynamic and agree that the Rent Credit Score may change based on your usage and engagement with the RentenPe Platform over time.

28.14.You understand that the 'Rent Credit Score' is merely an indicative score based on your usage of and engagement with the RentenPe Platform. While as a Landlord you may use this Rent Credit Score, you are requested to independently verify all information presented to you on the RentenPe Platform, and not rely solely on the Rent Credit Score for making any decisions.


29. TERMS SPECIFIC TO AADHAAR INFORMATION

29.1. You expressly consent to authorise us and our authorised Third Party Service Providers for verifying your Aadhaar details through an OTP, Aadhaar Extensible Markup Language ("XML") and other mechanisms for verification and authentication of Aadhaar details prescribed under Aadhaar (Targeted Delivery of Financial and other Subsidies, Benefits and Services) Act, 2016 and other Applicable Law for availing the Services.

29.2. You expressly consent to voluntarily opt for Aadhaar offline verification for background verification, and submit to us the XML, masked Aadhaar and / or your Aadhaar registered mobile number.

29.3. You agree and acknowledge that the collection of Aadhaar is solely for completion of background verification and is not mandatory document / information for availing our Services unless required under any Applicable Law.

29.4. Please note that RentenPe does not retain or store Aadhaar of any users on the RentenPe Platform. We may screen documents uploaded by you and delete Aadhaar if the same is provided by you outside of the verification process outlined above.


30. TERMS SPECIFIC TO CENTRAL KYC REGISTRY

30.1. You expressly and unequivocally consent to permitting us and / or our Third Party Service Providers to retrieve / procure / download your KYC information / details from Central KYC registry owned and operated by Central Registry of Securitisation Asset Reconstruction and Security Interest of India ("CERSAI") for the purposes of verifying / establishing your identity and information, including your Personal Information.

30.2. We and / or our authorised Third Party Service Providers may verify your details against any particulars available under Central KYC registry.

30.3. You agree and acknowledge that any inaccuracies in the information provided by you pursuant to the Residence Card shall provide an unconditional right to us, at any point in time, to revoke, suspend, or terminate your access to Residence Card and the RentenPe Platform and exercise all rights available to us against you under Applicable Law and the Agreement.


31. TERMS SPECIFIC TO RENTAL PAYMENTS

31.1. A Tenant may opt to undertake rental payments, maintenance payments and payments of security deposit / token amounts (collectively, "Rental Payments") through a payment gateway(s) authorised by RentenPe. These payments may be made on verification of a valid rental agreement only.

31.2. Tenants are required to provide customary billing information such as name, financial instrument information such as bank account number, Unified Payments Interface ("UPI") ID, mobile number, the relevant IFSC code, account details of the Landlord to whom the payment has to be made. Tenant's should ensure that they provide accurate, current, and complete information while making the Rental Payments through the RentenPe Platform, and it shall be the Tenant's obligation to always keep this information updated. Tenant's are solely responsible for the accuracy and completeness of the information provided by them and RentenPe shall not be responsible for any loss suffered by the Tenant as a result of any incorrect information, including payment information provided by the Tenant.

31.3. Landlords may also request Tenants to make Rental Payments through the RentenPe Platform. In all such cases, the Landlords appoint RentenPe as their agent to collect such payments from the Tenants.

31.4. RentenPe is not involved in any underlying transaction between the user, any other user, any third person or any service providers, with the exception of RentenPe's limited role in processing Rental Payment transactions that users authorise or initiate through the RentenPe Platform. RentenPe is not a financial institution and does not offer any banking or related services. RentenPe may use the services of one or more Third Party Service Providers to facilitate Rental Payments and process users transactions. However, the actual transfer of money, as well as requests for refunds / cancellations would be governed by the terms and conditions of Third Party Service Providers engaged by RentenPe to facilitate the Rental Payments. Further, RentenPe does not guarantee payment on behalf of any user's or Third Party Service Providers and explicitly disclaims all liability for any act or omission of any user or Third Party Service Provider.

31.5. The user acknowledges that RentenPe is authorised by the user to hold, receive and disburse funds in accordance with the user's payment instructions provided through the RentenPe Platform for the purposes of facilitating the transfer of Rental Payments to the intended beneficiary as specified by the Tenant on the RentenPe Platform and verified through a valid rental agreement. The authorisation given by the user's permits RentenPe (or Third Party Service Providers engaged by RentenPe) (a) to debit or credit the user's wallet, bank account, any credit card, debit card, or other payment cards or any other payment method that RentenPe accepts; or (b) to process payment transactions that the users authorise by generating an electronic funds transfer. By instructing RentenPe to pay another user, the users authorise and order RentenPe to make the payments (less any applicable fees or other amounts we may collect under this Agreement) to such user. RentenPe may limit the recipient's ability to use or withdraw the committed funds for such period of time that RentenPe has agreed to with the recipient.

31.6. The user agrees that they may be charged a service charge by RentenPe for using the RentenPe Platform to make Rental Payments.

31.7. RentenPe may delay, suspend or reject a transaction for any payment(s) for any reason, including without limitation if RentenPe suspects that the transaction subjects it to financial or security risk or is unauthorised, fraudulent, suspicious, unlawful, in violation of the terms of this Agreement subject to dispute or otherwise unusual.

31.8. The amount of a transaction may be charged back or reversed to the user (a "Chargeback") in case the transaction (a) is disputed by the sender; (b) is reversed for any reason; (c) was not authorised or RentenPe has reason to believe that the transaction was not authorised; or (d) is allegedly unlawful, suspicious, or in violation of the terms of this Agreement. The user's owe RentenPe and will immediately pay RentenPe the amount of any Chargeback and any associated fees, fines, or penalties assessed by RentenPe's Processor, processing financial institutions, or all authorised card networks, associations, or companies ("Networks"). The user's agree to assist RentenPe as and when requested, at their own expense, to investigate any of the user's transactions processed through the Service. For Chargebacks associated with credit or debit cards, RentenPe will work with the users to contest the Chargeback with the Network or issuing banks, in the event that the user chooses to contest the Chargeback. To this end, RentenPe will request necessary information from the user to contest the Chargeback and the user's failure to assist RentenPe in a timely manner in investigating a transaction, including without limitation providing necessary documentation within 2 days of RentenPe's request, may result in an irreversible Chargeback.

31.9. The users agree not to hold RentenPe responsible and / or liable for any issue or claim arising out of any dispute whatsoever between the user and the Third Party Service Provider and / or the user and the user's bank or financial institution.

31.10.RentenPe shall not be responsible for any additional fees or charges deducted by the Third Party Service Providers while processing payments in connection with the user's transaction and RentenPe disclaims all liability in this regard. Further, the users may also be subject to additional terms and conditions imposed by such Third Party Service Providers and the users should review these terms and conditions before authorising any payments through the Third Party Service Providers.

31.11.RentenPe may seek additional documents from you ('such as Tenant's or Landlord's PAN, maintenance bill, etc.') where it is deemed necessary, including in the event that a transaction appears suspicious. RentenPe will instruct the Third Party Service Provider undertaking the transaction to refund the full amount (excluding any processing fees collected by RentenPe) without any deductions if RentenPe determines it is not a valid Rental Payment or if such payment is fraudulent. A valid Rental Payment is one where there exists a valid rental agreement between the Tenant and the Landlord with the rent amount equivalent to what is being transferred through the RentenPe Platform. A valid maintenance payment is one where there exists a maintenance bill between the payer and the housing society.

31.12.In the event that a Rental Payment is unable to go through due to any technical difficulties, the payment would be refunded back to the source by the Third Party Service Provider as per its terms. Tenants are advised not to transfer the rent directly to the Landlord until a refund ID is generated and sent to the Tenant through email and SMS.

31.13.You agree and acknowledge that in case of failed / cancelled transactions, the RP Coins from the Wallet utilised if any shall be reversed. Provided however, in case of transactions identified as fraudulent, disingenuous or deliberately cancelled or reversed in an attempt to take advantage of an offer in a manner it was not intended to be used, RentenPe reserves the right not to reverse the RentenPe Coins utilised.

31.14.Users acknowledge and agree that, to the maximum extent permitted by law, the entire risk arising out of the user's access to and use of RentenPe Platform remains with the users. In the event that a user permits or authorises another Person to use their RentenPe account in any manner, the user shall be responsible for all actions taken by that Person. Neither RentenPe nor any other party or Third Party Service Provider involved in creating, producing, or delivering the Rental Payment Services will be liable for any incidental, special, exemplary, or consequential damages, including lost profits, loss of data or loss of goodwill, service interruption, computer damage or system failure or the cost of substitute products or services, or for any damages for personal or bodily injury or emotional distress arising out of or in connection with these payments terms.


32.TERMS SPECIFIC TO LOCKER

32.1.“Locker” is a repository of the documents uploaded by a User on the RentenPe Platform, which allows a User to store, access, and share the documents uploaded in the Locker with other persons. This feature may be accessed through the back of a User's Residence Card on the RentenPe Platform.

32.2.Users may upload and store any of the permitted documents listed on the RentenPe Platform such as their PAN card, driving license, voter card, passport, rental agreement, bank statement, etc. in their Locker. Documents such as the rental agreement and KYC documents which are uploaded by users to the RentenPe Platform and have been verified are automatically uploaded to the Locker.

32.3.[Documents stored in the Locker can be accessed by a User with or without biometric authentication or PIN verification. Users may modify the access settings of their Locker through the RentenPe Platform.]

32.4.Users can share documents stored in their Locker through generation of a link which permits the recipient of the link to download a copy of such document from the Locker. This link can be shared by the User through text-based messaging channels such as WhatsApp.

32.5.A 'Share Log' of the history of documents shared through Locker is also maintained on the RentenPe Platform. The Share Log can be accessed and viewed by the User whose documents are shared through the Locker.

32.6.RentenPe does not permit storage of certain categories of documents in the Locker as specified on the RentenPe Platform. RentenPe may screen and delete any documents which are not permitted to be stored in Locker if such documents are detected by RentenPe.

32.7.RentenPe is not responsible for ensuring that documents stored in a Locker are accurate or up to date, nor for any issues that may arise out of a User's reliance on the Locker.

32.8.Unless otherwise indicated on the Rentenpe Platform, Users are not required to make any payment to RentenPe to obtain access to their Locker.


33.TERMS SPECIFIC TO GULLAK AND WALLET

33.1.Gullak, Wallet, RentenPe Points and RentenPe Coins are features introduced on the RentenPe Platform by RentenPe.

33.2.RentenPe may issue RentenPe Points to you for engaging with and performing various actions on the RentenPe Platform such as completing your onboarding on the RentenPe Platform, making timely rent payments, referring the RentenPe Platform to your contacts, participating in promotions offered on the RentenPe Platform through the 'Rewards' section from time to time, etc.

33.3.RentenPe Points are credited to your Gullak, and can only be redeemed on the RentenPe Platform after 'breaking' your Gullak and transferring them to your Wallet in the form of RentenPe Coins. The specific conditions and time period after which the RentenPe Points are available for redemption to the Wallet will be communicated to you at the time of credit to your Gullak. In general, RentenPe Points which are to be redeemed towards making Rental Payments must be transferred to the Wallet at least 2 days prior to the rent due date.

33.4.RentenPe Coins in the Wallet can be used for making a portion or the entire amount for Rental Payment that is due, or to purchase one-time or subscription based Services available on the RentenPe Platform.

33.5.RentenPe Points and RentenPe Coins cannot be purchased by any user using real world money. The value of an RentenPe Point or RentenPe Coin is subjective and determined by RentenPe, and may be modified at any time.

33.6.RentenPe Points and RentenPe Coins do not have any monetary value and users will not be eligible for any monetary compensation in lieu of settlement against RentenPe Points or RentenPe Coins or in case of loss of the same.

33.7.RentenPe Points and RentenPe Coins which have been credited or debited to or from your Gullak or Wallet will be reflected on the RentenPe Platform. You can also view the RentenPe Points and RentenPe Coins accumulated by you on the RentenPe Platform.

33.8.RentenPe Points and RentenPe Coins cannot be converted to cash and are not transferable. Any wrongful transfer of RentenPe Points and RentenPe Coins shall be void ab initio.

33.9.RentenPe Points and RentenPe Coins have 3 months validity, except in circumstances detailed below:

• If the Gullak or Wallet is not used for more than 90 days, the RentenPe Points and RentenPe Coins will be nullified.

• RentenPe reserves the right to cancel or suspend the accrued RentenPe Points or RentenPe Coins if the user is in arrears, suspension or default or if the user's account is or is reasonably suspected to be operated fraudulently.

• In case of user's death, the RentenPe Points and RentenPe Coins earned but not redeemed at that time will be forfeited.

• On closure / termination of the user's relationship with RentenPe, any RentenPe Points and RentenPe Coins pending to be claimed in the user’s Gullak or Wallet will be forfeited.


34.TERMS SPECIFIC TO R SAFETY

RentenPe offers the following value-added services and features to users registered as Landlords either free of cost or on payment of such amounts as specifically indicated in the Rentenpe Platform (“R Safety”). These can be availed on a one-time basis or on a subscription basis. Please note that RentenPe reserves the right to modify, cancel, refuse, or withdraw any of the Services listed below at any point at its discretion.


34.1.Instant ID Check

'Instant ID Check' is a paid identity verification service offered through the RentenPe Platform by RentenPe through its Third Party Service Providers, to any users that wish to verify the identity of their contacts. This identity verification can, inter alia, be used by Landlords to verify the identity of prospective tenants and vice-versa.

• Any user of the RentenPe Platform may access this feature either through the website or mobile application operated by RentenPe.

• The user can upload one document at a time for verification from the available documents listed on the RentenPe Platform through Instant ID Check such as PAN card, Aadhaar card, driving license, passport, etc. A Landlord can also conduct a Residence Card number check on potential tenants through Instant ID Check, wherein the unique ID number assigned to a Tenant can be verified through the RentenPe Platform.

• The user is required to make a one-time payment of such amounts as indicated on the Rentenpe Platform for each document they wish to verify through Instant Profile.

• The user shall obtain required consent from their contacts as may be required under Applicable Law prior to submitting their personal information / uploading their identity documents for Instant ID Check.


34.2.Rental Dashboard

• The 'Rental Dashboard' comprises of a digital interface which displays information relating to the tenancy and ongoing rental journey including the Tenant’s verified documents and details of Rental Payment history. Landlords may access the Tenant's dashboard with whom they have entered a valid rental agreement which has been verified by RentenPe.

• RentenPe reserves the right to alter, delete, or add relevant information relating to the Tenant on the Tenant Dashboard.

• Unless otherwise indicated on the Rentenpe Platform, Landlords are not required to make any payment to RentenPe to obtain access to the Tenant Dashboard.


34.3.Rental Tracker

• The 'Rental Tracker' comprises of a digital interface which provides an overview of timely, overdue, and missed Rental Payments in relation to valid rental agreements between a Landlord and their Tenant(s).

• RentenPe reserves the right to alter, delete, or add relevant information relating to the Tenant on the Rental Tracker.

• Unless otherwise indicated on the RentenPe Platform, Landlords are not required to make any payment to RentenPe to obtain access to their Rental Tracker.


34.4.Court Track Check

'Court Track Record' is a paid service through which RentenPe, either through itself or through Third Party Service Providers, conducts comprehensive checks of current tenants' / prospective tenants' publicly available court records to confirm whether they possess a clean legal history.

• RentenPe shall not be liable for any inaccuracy / incorrectness of the information displayed to Landlords while accessing Court Track Record services. While RentenPe makes reasonable efforts to ensure the accuracy and correctness of the information displayed to Landlords while accessing Court Track Record services, the same should not be construed as a statement of law or used for any legal purposes. In case of any ambiguity or doubts, Landlords are advised to verify / check with the relevant authorities.

• In providing Court Track Record services, RentenPe does not guarantee or certify the suitability / character of any tenant. It merely aims to provide Landlords with relevant information to make informed choices.

• Landlords can avail Court Track Record services on a per tenant basis, through payment of such amounts as indicated on the RentenPe Platform.


34.5.Exit Feedback

• Through the 'Exit Feedback' feature, a Tenant may document their insights in relation to the overall rental experience, rental property conditions, Landlord interaction, society treatment, and any other notes on the RentenPe Platform at the time of vacating a Landlord’s rental property on expiry of a valid rental agreement or for any other reason.

• The information furnished by a Tenant through Exit Feedback is confidential, and can only be viewed by the Landlord.

• Unless otherwise indicated on the RentenPe Platform, Landlords are not required to make any payment to RentenPe to obtain access to the Exit Feedback.


34.6.Home Address Verification

• RentenPe provides 'Home Address Verification', either through itself or through its Third Party Service Providers. Home Address Verification is a comprehensive permanent home address verification service through which a Landlord can confirm the accuracy and validity of a physical address provided to them by a Tenant or a prospective tenant. This includes verifying the details of the given address such as the house number, street name, city, state, pin code, etc. to ensure that it corresponds to a legitimate location, along with pictures of the house and an interaction report with the family members of the Tenant or potential tenant.

• By registering on the RentenPe Platform, Tenants consent to their permanent home address being verified by a Landlord through the RentenPe Platform by availing Home Address Verification Services.

• If you as a Landlord wish to avail Home Address Verification of a tenant not registered on the RentenPe Platform, you are required to obtain the tenant's consent by downloading this form1 and having the tenant fill out and upload the completed form on the RentenPe Platform / email the consent form to us at Support@rentenpe.com.

• Landlords can avail Home Address Verification services, on a per tenant basis, through payment of such amounts as indicated on the RentenPe Platform.


34.7.Rental Analytics

• Through 'Rent Analytics', RentenPe provides a comprehensive overview and market insights for rental trends (such as monthly rent for furnished versus semi-furnished rental apartments) to Landlord through the RentenPe Platform.

• Rent Analytics would be made available to you on the basis of the location of your rental property which you share with RentenPe.

• Unless otherwise indicated on the RentenPe Platform, Landlords are not required to make any payment to RentenPe to obtain access to the Rental Analytics.

• Rental Analytics is offered by RentenPe at its discretion and RentenPe may withdraw or alter aspects of this feature at any time. The information available through Rent Analytics is for the sole purpose of providing general information and should not be considered as recommendations or legal, financial, or real estate advice from RentenPe.


34.8.Fast Track Tenancy

'Fast Track Tenancy' comprises of a subscription-based service offered by RentenPe to Landlords under which RentenPe will provide assistance to Landlords (whose property is vacated with no replacement tenant in place) to find new tenants within a stipulated time duration (as detailed below), failing which RentenPe will compensate Landlords for interest loss incurred by them (as detailed below).

• In providing Fast Track Tenancy services, RentenPe will assign a third-party broker to the Landlord who will assist the Landlord in securing a replacement tenant for the Landlord's property within 30 days from the date of assignment of the broker to the Landlord.

• The Landlord can communicate their parameters for potential new tenants with the broker, and the broker will aim to work as per these instructions. Please note that RentenPe has no control over the services provided by the broker to a Landlord through the RentenPe Platform as they are independent of RentenPe and not an employee of RentenPe. RentenPe will not be responsible in case of any issues that may arise in relation with the assistance provided by the broker.

• In the event that the broker assigned by RentenPe is unable to find suitable tenants for the Landlord within 30 days from the date of assignment of the broker to the Landlord, RentenPe would compensate the interest loss for up to 15 days of the month excluding the first 15 days of that month.

• The interest payable to the Landlord would be determined on a pro-rated basis as per the yearly interest rate communicated at the time of purchasing a subscription to Fast Track Tenancy services.

• Landlords can avail Fast Track Tenancy services for each rental property on a subscription, through payment of such subscription fees as indicated on the RentenPe Platform.


34.9.On Time Rent

'On Time Rent' comprises of a subscription-based service offered by RentenPe to Landlords under which RentenPe will provide assistance to Landlords to collect timely Rental Payments, failing which RentenPe will provide interest amounts for each day of delay in Rental Payments due to a Landlord, in a manner as detailed below.

• In the event that a Rental Payment is delayed, RentenPe will compensate the interest loss suffered by the Landlord for each day of delay, for up to a maximum of 30 days of delay each Quarter. For the purposes of On-time Rent services, a ‘Quarter’ comprises of three calendar months starting from the calendar month in which the Landlord subscribes to On-time Rent services on the RentenPe Platform.

• The 30-day cap on interest is refreshed every Quarter. However, it is clarified that there shall be no carry-over of days on a quarter to quarter basis and the maximum number of days for which RentenPe will compensate interest loss to a Landlord in a Quarter is capped at 30 days.

• The interest payable to the Landlord would be determined on a pro-rated basis as per the yearly interest rate communicated at the time of purchasing a subscription to On-Time Rent services.

• Landlords can avail On Time Rent services for each rental property on a subscription, through payment of such subscription fees as indicated on the RentenPe Platform.


34.10.Lucky Draw

• Users may be eligible to participate in exclusive ‘Lucky Draws’ conducted by RentenPe from time to time.

• RentenPe may, at its sole discretion, offer rewards to users through Lucky Draw based on the duration of their subscription to the Eligible Services in quarterly increments as specified on the RentenPe Platform.

• Participation in Lucky Draw is not conditional upon purchase of any specific ticket / buy-in offered on the RentenPe Platform. It is solely based on the user’s subscription to the Eligible Services. However, participation in Lucky Draw does not automatically entitle users to a reward.

• Rewards from Lucky Draw will vary based on the period of subscription to the Eligible Service, i.e., a user may be eligible for larger rewards if they avail a subscription for a longer period. Details of the rewards are available on the RentenPe Platform, and may be modified by RentenPe at any time.

• RentenPe retains absolute discretion to determine the eligibility of a user to participate in Lucky Draw or receive a reward. RentenPe’s decision on all matters relating to Lucky Draw (including but not limited to the number of rewards to be awarded to any user, and the selection of winners) shall be final and binding on all participants.

• Rewards are not refundable nor exchangeable for cash or other rewards. RentenPe shall have no legal liability relating to any aspects of the prizes including but not limited to their quality, supply, delivery and maintenance.

• RentenPe will not be responsible for any tax implications on any user from their participation in Lucky Draw. No user is guaranteed any rewards in respect of their participation in the Lucky Draw.

• RentenPe may vary these terms or withdraw or terminate the Lucky Draw at any time without any notice or liability to any party.


35.TERMS SPECIFIC TO CHAT, ESCALATION, AND VIDEO CONSULTATION

RentenPe offers the following features and services to Tenants and Landlords for streamlined communication related to their rental relationship through the digital space made available on the RentenPe Platform.


35.1.ChatBox

'ChatBox' is a text and image-based messaging channel made available on the RentenPe Platform that allows Tenants and Landlords to communicate with each other, solely in relation to their rental relationship arising under a valid rental agreement in a streamlined and secure manner.

• By availing ChatBox services, the users consent to sharing of all text and image-based information provided by them on Chat with relevant third parties, including for the purposes of availing Escalation or Video Consultation services.

• Landlords and Tenants can avail ChatBox services on a subscription basis, through payment of such subscription fees as indicated on the RentenPe Platform.

• ChatBox services may be used only if both the Landlord and Tenant have availed ChatBox services by paying the applicable subscription fees. If a Landlord / Tenant who has availed ChatBox services (by paying the relevant subscription fee) wishes to initiate a chat with a Tenant / Landlord (as applicable) who has not availed ChatBox services (by paying the relevant subscription fee), a message will be sent to the relevant Tenant / Landlord who has not availed ChatBox services (i) informing them that their Landlord / Tenant wishes to initiate a chat with them on the RentenPe Platform and (ii) providing them with the link to the RentenPe Platform from where they can subscribe to the ChatBox services.


35.2.Escalation

• In relation to unresolved issues / disputes detailed in the Chat, the Landlords / Tenants may avail ‘Escalation’ services from RentenPe through which they can obtain a formal summary report (“Chat Summary Report”) prepared by a qualified lawyer (“Legal Expert”) detailing the factual circumstances relating to the relevant issue / dispute.

• The Chat Summary Report provides a bird’s eye view of the communication and chronological events underlying an issue / dispute between a Tenant and Landlord through the RentenPe Platform.

• The Chat Summary Report along with any advice offered by the Legal Expert in relation to the dispute would be shared via email with the user that raises the Escalation request.

• A Legal Expert is automatically assigned to a Landlord / Tenant on initiation of Escalation. This Legal Expert may also reach out to the Tenant and / or the Landlord through suitable media (such as telephone, email, WhatsApp, etc.) to speak with them and understand the dispute further.

• RentenPe is not a marketing agent of the Legal Experts. It merely facilitates / connects the users with Legal Experts. Escalation services and any electronic communication exchanged with the user pursuant to the Escalation services does not create a lawyer-client relationship between the user and RentenPe.

• Please note that RentenPe is in no way, directly or indirectly, responsible for (i) the Chat Summary Report prepared by a Legal Expert, and / or (ii) any other assistance / advice provided by the Legal Experts pursuant to the Escalation services. The Legal Experts are independent of RentenPe and not an employee / agent of RentenPe and accordingly, RentenPe has no control over the services provided by the Legal Experts.

• RentenPe will not be responsible in case of any issues / discrepancies that may arise in relation with the services provided by a Legal Expert.

• Landlords and Tenants can avail Escalation services on a per issue / dispute basis, through payment of such fees as indicated on the RentenPe Platform.


35.3.Video Consultation

• In relation to unresolved issues / disputes detailed in the Chat, in addition to Escalation services, the Landlords / Tenants may also avail ‘Video Consultation’ services through the RentenPe Platform for connecting with a Legal Expert to obtain such expert’s assistance / opinion on the relevant issue / dispute at hand.

• You may schedule appointments with the Legal Expert assigned to you in order to discuss rental-related issues over a video call, and share Chat Summary Reports generated via Escalations to support your position in relation to any disputes with the Tenant or Landlord (as relevant).

• RentenPe is not a marketing agent of the Legal Experts. It merely facilitates / connects the users with Legal Experts. Video Consultation services and any electronic communication exchanged with the user pursuant to the Video Consultation services does not create a lawyer-client relationship between the user and RentenPe.

• Please note that RentenPe is in no way, directly or indirectly, responsible for any assistance / advice provided by the Legal Experts pursuant to the Video Escalation Services. The Legal Experts are independent of RentenPe and not an employee / agent of RentenPe and accordingly, RentenPe has no control over the services provided by the Legal Experts.

• RentenPe will not be responsible in case of any issues / discrepancies that may arise in relation with the services provided by a Legal Expert.

• Landlords and Tenants can avail Video Consultation services on a per issue / dispute basis, through payment of such fees as indicated on the RentenPe Platform.


36.TERMS SPECIFIC TO R WISH

36.1.Landlords and Tenants may apply for a short term loan (“R Wish Loan”) offered by Third Party Service Providers through the RentenPe Platform to meet their rental obligations. The R Wish Loan facility is offered at RentenPe’s discretion, and RentenPe may choose to introduce, vary, or withdraw this facility at any time. RentenPe does not guarantee or assure that R Wish feature would be available to any Tenant or Landlord at any point.

36.2.Tenants may apply for an R Wish Loan on the condition of utilisation of amounts received through an R Wish Loan towards timely payment of rent due to a Landlord or any other purpose specified by the Third Party Service Provider issuing the R Wish Loan to the Tenant.

36.3.Landlords may apply for an R Wish Loan for the purpose of (i) availing advance rent; (ii) repayment of a tenant's security deposit, or (iii) or any other purpose specified by the Third Party Service Provider issuing the R Wish Loan to the Tenant.

36.4.All R Wish Loans made available to you by any Third Party Service Provider shall be governed by terms and conditions agreed between you and the Third Party Service Provider, and RentenPe is not a party to the same. R Wish Loans are issued to you at the sole discretion of the Third Party Service Provider and accordingly, the Third Party Service Provider may decline to issue an R Wish Loan to you at any stage of the loan disbursal process. Tenants and Landlords are not assured an R Wish Loan on account of their usage of the RentenPe Platform.

36.5.By applying for / availing loan facilities of Third Party Service Providers though the RentenPe Platform, you agree that your participation in the R Wish Loan facility is purely at your will and consent.


37.R WISH LOAN DISCLAIMER

37.1.RENTENPE OWNS, OPERATES AND MAINTAINS THE RENTENPE PLATORM WHICH IS SOLELY A TECHNOLOGY PLATFORM. WE ARE NOT A LENDER. WE HAVE CONTRACTUAL RELATIONSHIPS WITH THIRD PARTY SERVICE PROVIDERS INCLUDING REGULATED ENTITIES SUCH AS BANKS AND NON-BANKING FINANCIAL COMPANIES THAT ACT AS LENDERS PURSUANT TO WHICH SUCH THESE LENDERS OFFER LOAN FACILITIES TO THE REGISTERED USERS OF THE RENTENPE PLATFORM. ANY LOAN FACILITY MADE AVAILABLE TO YOU BY ANY LENDER SHALL BE GOVERNED BY TERMS AND CONDITIONS AGREED BETWEEN YOU AND THE LENDER AND WE SHALL NOT BE A PARTY TO THE SAME. LOAN SHALL BE AT THE SOLE DISCRETION OF SUCH LENDER.


37.2.YOU ARE FURTHER ADVISED NOT TO GET LURED AND BE WARY OF ANY CALLS, SMS AND EMAILS ASKING FOR DEPOSITING ANY PROCESSING FEES / CHARGES IN RETURN FOR EXPEDITING LOAN APPROVALS. WE ADVISE YOU TO BE CAUTIOUS WHILE RECEIVING FRAUDULENT AND FICTITIOUS CALLS. AS SUCH, WE CANNOT BE HELD RESPONSIBLE FOR ANY LOSS SUFFERED BY A PERSON WHILE DEALING WITH FAKE AND FRAUDULENT ORGANISATIONS IMPERSONATING THEMSELVES AS RENTENPE OR OUR THIRD PARTY SERVICE PROVIDERS.
